The present conditions aim at defining the conditions of sale between DUCATILLON and the customer, from the placing of the order to the delivery. These conditions concern only natural persons who are not merchants, of legal age and with the legal capacity to contract. The "DUCATILLON" brand is marketed by mail order and on the Internet. The following provisions establish the General Conditions of Sale of the products proposed on this site by the company DUCATILLON represented by its director of the publication Jean Marc Bernard.

The present general conditions govern the sale of the products presented in our catalogs and on our website www.ducatillon.at/gb/. The fact, for any customer to place an order on the website www.ducatillon.at implies the whole acceptance and without reserve of the present conditions. Ducatillon reserves the right to modify at any time the present conditions. Consequently, it is up to the customer to make sure, at the time of each order, that he has the last general conditions of sale in force and permanently available on the website www.ducatillon.at/gb/. The website www.ducatillon.at/gb/ is dedicated to the physical persons not trading established in Austria.

Products

Only the essential characteristics of the products are mentioned on the site. The customer is invited to take note of the instructions for use and all other information attached to the product or on its packaging (assembly instructions, conditions of use, precautions for use, etc.). Please note that product photos are non-contractual.

Order

Course of order:

The customer selects the desired product or products, specifies the order quantity, clicks on "Add to cart" and then on "Order". The customer provides his contact details. He selects both the shipping method and the method of payment. An order overview appears. Up to this page, the customer can change his order by clicking on the appropriate icons. The final order confirmation is made either by entering the credit card data (16 digits on the front of the card and the expiration date and the verification number (the last 3 digits on the back of the card)) in case of online payment by Visa or Mastercard type credit card, by entering the pin code in case of payment by Maestro, or by clicking on the icon that determines the payment method chosen by the customer. For the successful processing of the order, the customer is obliged to provide all the necessary information on the website (address, floor, door code). The information provided by the Customer is considered as a confirmation of the transaction between "DUCATILLON" and the Customer. Once this confirmation is received, the order is binding and will be automatically saved. This is confirmed by an e-mail from DUCATILLON to the e-mail address provided by the Customer. Orders are stored for a period of 10 years and can be accessed by the customer at any time during a period of 1 year in the section "My customer account".

Availability

Product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. In the event of unavailability of products after placing an order by the customer, the customer will have the option of ordering another item or requesting a refund of the price paid.

The prices

The prices are indicated in Euros, including all taxes and excluding the preparation and shipping costs which are charged to the customer. These prices are applicable within the framework of the remote sale. The VAT included is the Austrian VAT (Value Added Tax). The amount of these preparation and shipping costs is determined by the weight, volume or different characteristics of the products ordered. The weights are displayed on each product sheet of the site. The amount of the shipping costs is displayed at the time of payment.

Prices:
All our prices are quoted in euros and include the Austrian VAT in force on the day of the order. Prices are guaranteed on the day of the order and are subject to available stock. Ducatillon reserves the right to modify its prices in case of printing or typing errors.

Delivery

Delivery time for items in stock is on average 4 to 7 days and maximum 2 weeks - especially when shipping heavy packages. In case of card payment, these delivery times apply only from the moment the order is confirmed by the seller. In the event of force majeure, the stated deadlines are extended. Cases of force majeure include, but are not limited to, partial or total loss of personnel at the Seller or any of its suppliers, subcontractors or carriers as a result of a strike, as well as fires, floods, industrial accidents, breakage of machinery or tools, shortage of raw materials, a ban or suspension of imports or exports, and the refusal, restriction or withdrawal of import or export licenses, etc. Parcels under 30Kg will be sent by Colissimo, Chronopost or GLS. According to the legislation in force, you can cancel an order within 30 working days if the delivery is delayed for more than 7 days. If the package arrives despite your cancellation, contact us at by email at kundenservice@ducatillon.com and we will refund the purchase price of the products once we receive them in their original condition and without any alteration. We ship packages weighing more than 28 kg by DHL. We process our orders on a first-come, first-served basis, and delivery times may vary depending on the weight of your package. You can opt for home delivery, with delivery times of 4, 6, 7 or 8 days for Austria, 4 to 6 days for Germany, 3 to 6 days for Luxembourg and 5 to 6 days to Switzerland. These delivery times do not take into account holidays and weekends. Delivery is conditional on full payment of the order, including processing and shipping costs. These costs vary depending on the products ordered and the geographical delivery zone and will be indicated before the order is confirmed. Please note that if packages or items are missing from delivery or arrive in damaged condition, the appropriate notification of loss or damage to the goods must be made on the recipient's confirmation and sent by mail within 48 hours. No full support can be provided by Ducatillon in case no notification of loss or damage has been made by the customers to the carrier.

Property reserve:

The products ordered remain the property of DUCATILLON until full payment of the price.

Returns / Refunds and exchanges

Pursuant to Article L121-16 et seq. of the Consumer Code, according to the law, the customer has 14 days from the delivery of the items to exercise his right of withdrawal, without having to give any reason. DUCATILLON will refund all payments for the goods affected by the withdrawal within 14 days after receipt of the corresponding products or after receipt of a proof of shipment by the customer. In case of a revocation, the products will be returned at the expense and risk of the customer. After these 14 days, the customer has a new period of 14 days to return the item and/or request an exchange or refund, which will be made without shipping costs. In all cases, the products must be returned in their original packaging, in perfect condition and complete with all instructions and accessories. The customer must include the cancellation form in the package. The return of the products is always at the expense and risk of the customer. This right may not be exercised for products made at the customer's request (personalization of a product, customized products, etc. ).

In case of rejection of the already sent order by the shipper and in case the order is still in the process of delivery, the shipper will charge the customer for the cost of returning the goods to the warehouse. The amount of these costs will be deducted from the refund of the order placed by the customer.

Eco-participation

The electrical appliances have the WEEE symbol (Waste Electronic and Electrical Equipment) meaning that at the end of their life, they should not be mixed with household waste. The materials used to manufacture these devices may contain substances that are hazardous to the environment and human health. The treatment of waste allows us to contribute to the enhancement of our environment. For any purchase of an electrical or electronic device, DUCATILLON will take back your used device free of charge (device of the same nature).

Warranty

Contractual : The materials with electric resistances, thermostat, electric motors are guaranteed 6 months or 1 year according to the manufacturers (except spare parts). We decline all responsibilities for any material not assembled by our care. The warranty is limited to the repair, replacement or reimbursement in value of the goods recognized as defective by the seller, provided that the customer has not intervened on the products himself or through a third party since their delivery. In general, the guarantee cannot be implemented in the event of normal wear and tear of the goods, damage caused by misuse or use that does not comply with the rules and precautions for use set out in the instructions, poor maintenance, negligence, incorrect handling or installation, transformation of products, etc. Any return must be subject to the prior agreement of the seller and is always at the customer's expense. All returns must include a copy of the invoice and a note detailing the reasons for the return. Legal : DUCATILLON complies with the legal texts concerning the legal guarantee of conformity and hidden defects.

Personal data

Ducatillon is committed to protecting the privacy of individuals and the confidentiality of information provided. The information and data concerning you, requested by Ducatillon, responsible for the treatment, are necessary for the recording and the follow-up of your order, for the commercial and marketing management of your file, for the quality of our relations and for the good execution of the contract. This information and data is kept for a maximum of 10 years to enable us to improve and personalize the services we offer you and the information we send you. Your data may be communicated to our subcontractors, in particular logisticians, carriers for the purpose of executing your order. The parties agree that the contract is subject to French law and that only the French courts can hear these disputes, the language of the original General Terms and Conditions of Sale being French. It is also agreed that in the event of a potential dispute, the parties will first make every effort to find an amicable solution and agree, if necessary, on the competent court.
